County human service agencies are eligible to enroll with Minnesota Health Care Programs (MHCP) to provide and bill for OICC services.

Counties must complete the Officer-Involved Community-Based Care Coordination Assurance Statement (DHS-7340) (PDF) and email the completed form to communitybased-coordination.dhs@state.mn.us.

Staffing requirements

A county employee or subcontractor of a county that provides OICC must be one of the following:

• a mental health professional, as defined in Minnesota Statutes 245.462, subdivision 18,
• a mental health practitioner qualified according to section Minnesota Statutes, 245I.04, subdivision 4, working under the treatment supervision of a mental health professional according to section Minnesota Statutes, 245I.06, or
• a mental health certified peer specialist qualified according to section Minnesota Statutes, 245I.04, subdivision 10, working under the treatment supervision of a mental health professional according to section Minnesota Statutes, 245I.06

Eligibility for OICC

To be eligible for OICC, a person must:

• be eligible for Medical Assistance (MA, NM, RM),
• have had contact with law enforcement,
• have screened positive for benefiting from treatment for a mental illness or substance use disorder, 
• agree to participate in services, and
• not be considered an “inmate of a public institution.” (Refer to the following chart for examples.)

Requirements:

• The provider must complete Officer-Involved Care Community-Based Care Coordination Screening Tool (DHS-7305) (PDF) or another screening tool approved by the commissioner as part of screening the person for OICC eligibility.
• If your organization has identified an alternative screening tool as more appropriate for your setting, send it to communitybased-coordination.dhs@state.mn.us for review and approval prior to providing services.
• Services include working with other providers to coordinate services. The goal is to help the individual access a variety of services to reduce the number of visits to a hospital emergency department or inpatient readmissions for non-medically necessary health care. These services must address the individual’s needs determined in the initial assessment. Services may be provided in the individual’s living environment or by phone.

Limitations

• A person who has screened positive for benefiting from treatment for a mental illness or substance use disorder is eligible for OICC for up to 80 hours during a 60-day period per calendar year, beginning with the first day of service.
• If a person has not used 80 hours of OICC within a 60-day period, additional periods of service eligibility can be authorized. To request authorization for additional periods of service eligibility, contact communitybased-coordination.dhs@state.mn.us.
• A person is limited to two 60-day periods of OICC services in a year.

Payment for duplicative services is prohibited. The following are considered duplicative of OICC:

• Adult mental health targeted case management (AMH-TCM)
• Children’s mental health targeted case management (CMH-TCM)
• Relocation service coordination targeted case management (RSC-TCM)
• Vulnerable adult/developmental disability targeted case management (VA/DD-TCM)
• Health care homes (HCH) care coordination
• Behavioral health home (BHH) services
• Integrated Health Partnership (IHP) demonstration project
• Residential treatment services
• Intensive residential treatment services (IRTS)
• Institution for mental disease (IMD)

A person who meets the eligibility criteria for one or more of these covered services listed here must choose which service best meets their needs.

County employees or subcontractors of a county that provide OICC are required to report the following on an annual basis to DHS:

• The number of individuals served
• The number of community-based services accessed by individuals receiving services

Documentation must include the following:

An Individual Support Plan, which must include:

• statement of the goals for the individual
• description of activities or tasks that will help the individual accomplish each goal
• schedule for each task or timeline for completion of these goals

Contact or Progress Notes, which must meet MHCP service record requirements and include the following to ensure good communication, planning and billing support:

• support plan goals addressed
• services provided 
• person’s response to the service
• any significant observation of the person’s situation or condition (for example, current risk factors the individual faces or any changes in physical or mental health symptoms)
• communication with the person’s family members, support system, other providers, doctors, resource representatives and community representatives 
• referrals or coordination provided
• plan for the next contact, or a discharge plan with the individual’s decision for ongoing treatment and service coordination
• signature and qualifications of the person providing the service
